advising that the property meets all requirements as outlined in the Road.

present Zoning Py-law. Additionally, the report requests confirmation
that a Board of Variance decision of July 16th, 1974 is still applicable
to the property in question with respect to rear yard clearances.

Prior to passage of the foregoing resolution Alderman Traboulay
questioned the City Clerk as to whether the 1974 Board of Variance
decision would still apply and the City Clerk replied in the affirmative.
Alderman Mabbett queried whether or not the Mary Hill Restrictive Covenant
would apply to this property and therefore affect this application and
the City Administrator advised that this would have to be resolved
between the owner of the property and Mutual Development Corporation as
it was not the City's place to enforce any Restrictive Covenants registered

against the property.
