All other words and expresstons in this Agreement, unless the context otherwise requires, shall have the meaning assigned to thea by the "City of Port Coquitlam Zoning By-law, 1969, No, 918", as amended or, if noc defined therein, by the "Muncipal Act" or the “Interpretation Act" of the Province of British Columbia. The Developer is the registered ower of an estate in fee simple of ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the City of Port Coquitlam, in the Province of British Coluntia, and being nore particularly known and deseribed as: Lot 82, Block 32, District Lot 464, Group One, Plan 46962, New Westminster District, (hereinafter called "the lan The Developer has obtained the consent of all persons holding any istered interest in the land as set out in the Consents to the use ¢ cevelopaent set forth herein, which Consents are attached hereto. {a) The lend, including the surface of water, and any and all bufldings, structures and improvements erected thereon, there- over or therein shall be used only for those uses permitted in PM-L (Low-Density Apartment Residential) zones in the City and for no other purposes whatsoever, Except as otherwise provided in this Land Use Contract the above-noted uses shall be permitted to the linit and extent provided in Part V of the “City of Port Coquitlam Zoning By- law, 1969, No. 918" as in force on the date of registration of this Agreecent in the Now Westminster Land Registry Office as if the said use was occurring on property zoned RM~l (Low- Density Apartment Residential) under the said Zoning By-law. A copy of the said Part V ts attached hereto as Appendix 1. 5. (a) No building. strucrure or imorovement shall be sited upon the land except in compliance with the site plan and particulars set out in Anvendix 2 to Avpendix 6 herein which contain the following designations: i. Appendix 2 ~ Drawing No. Al, Job No. 7237, Poul E. Hansen, Architecc, Site Plan and Excerior Lighting. : 41. Appendix 3 ~ Drawing No. A2, Job No. 7237, Pout &, Hansen, Architect, Landscape Plan. iii. Appendix 5 - Drawing No. AS, Job No. 7237, Poul E, Nansen, Architect, Roof and Foundation Flan Detail and Door and Window Schedule. Appendix 6 ~- Drawing No. AS, Job No. 7237, Poul E. Hansen, Architect, Elevations, Section and Room Finish Schedule, (b) All construction details shail conform to the provisions of the applicable portions of the National Building Code of Canada, the British Columbia Plumbing Code, and the “City of Port Coquitlan Building and Plumbing Code Administration By-law, 1974, No. 1298". 6. Notwithstanding the provisions of the "City of Port Coquitlam Subdivision of Land By-law, 1970, No. 992" the land shall not be subdivided in any manner whatsoever. 7. No sign or signs shall be erected upon the lard or on any building structure thereon except those shown and set out in the particulars the Appendices hereto, Off-streec parking, loading snaces, playground areas, playgroun equipment, garbage pick-up areas, and other facilities and anenitics shall be provided, located and constructed in accordance with the Appendices hereto. + All buildings and structures shall be constructed strictly in compliance with and according to the plans, elevations and perspective set out in the Appendices hereto, provided however that ninor alterations to the plans may be parnitted and approved by the Building Inspector. 10. All landscaping, surface treatments, fences and screens shall be constructed, located, provided and maintained in coapliance with and according to the plans set out in the Appendices hereto. . 11. All roadway improvements and utilities, including water, sewer, gas, telephone, and electricity shall be Placed, provided, and constructed in compliance with and according to the plans prepared by the Developer and approved by the City Engineer. 12. The Developer covenants and agrees to apply for a building perric under the provisions of the "City of Port Coquitlam Building and Pluxbing Code Administration Bylaw, 1974, No. 1298" and pay the Yequisite building permit and plumbing permit fees prescribed therein plus the sun cf $300.00 for each self-contained housing unft which said sum che City shall credit to the Waterworks Utility Capital Replacement Fund.
