Director of Planning Rezoning and Official Community Plan Amendment Applications 1637, 1669, 1711 Mary Hill Road Planning and Development Committee ~ May 8, 1990 It is recommended that this application for rezoning from A-1 to RS~2 and RM-3 be approved to proceed under Section 963 of the Municipal Act as follows: a. 1711 Mary Hill Road to be rezoned to RS—23 b. 1669 and 1637 Mary Hill Road to be rezoned to RS-2 and RM-3 as shown on the attached Drawing No. 1. The approval to proceed of this rezoning to be subject ic: 1. A no~build restrictive covenant to be placed over the portions of i711 and 1669 Mary Hill Road located on the east side of the proposed extension of Shaughnessy Street; Bosa Development Corporation redesigning the extension of Shaughnessy Street or reaching an agreement with the proprietors of 1691 Mary Hill Road, to allow for the immediate construction to full Municipal stendards of the Shaughnessy Street Extension; The concerns expressed by the Municipal Engineer regarding detailed Engineering design for the extension of Shaughnessy Street and full technical advise regarding stability of the steep slope, to be addressed prior to final adoption of the Rezoning Bylaws; Park dedication in the amount of 5 percent of the applicants lands, to be located in the approximate locations shown in the attached Drawing No. 2 and all necessary works to make the "Poco Trail" usable to the satisfaction of the Parks and Recreation Department, to be undertaken by the Developer; The area designated for townhouse development as shown in Drawing No. 1 to be declared a Mandatory Development Permit Area; Input from the Federal/Provincial Fisheries; Compliance with the servicing standards of the Subdivision Bylaw to the satisfaction of the Municipal Engineer; ITEM | PAGE \Vlo J 31
