The areas of any building to be utilized for undercover parking of motor vehicles shall be exempt from elevation and landfilling requirements, provided they are left. undeveloped and unfinished. The site grading plan shall provide for a pedestrian egress route from each unit to high ground to the east of the property. No section of this pedestrian route shall be of an elevation of less than five point five (5.5) metres Geodetic Survey of Canada Datum. The owner acknowledges that the Province of British Columbia does not represent to the owner or any other person that the building constructed or mobile home located in accordance with paragraph (1) herein will not be damaged by flooding or erosion, and the owner covenants and agrees not to claim damages from the Province or the Corporation of the City of Port Coguitlam or hold the Province or the Corporation of the City of Port Coquitlam responsible for damages caused by flooding or erosion to the land or to any building, improvement, or other structure built, constructed or placed upon the said lands and to any contents thereof. All the parties hereto covenant and agree that the restrictions and covenants herein contained shall be covenants running with the land and shall be perpetual. This Agreement shall enure to the benefit of and be binding upon the parties hereto, their respective successors and assigns.
