COAST EMPLOYERS’ COUNTER - PROPOSALS Heading the list of demands in the employers’ counter proposals to the Union, is once again the request for the con- tinuous seven day work week and a new legal clause which would effectively prevent the IWA combatting the employ- . ers violating any section of the contract. ; Following are the employ- ers’ proposals: ARTICLE IV— -SHOP COMMITTEE 1.—Composition Amend Section 2 to pro- vide: (a) In operations employing 100 persons or less, the Shop Committee shall not exceed 3 employees. (b) In operations employing’ over 100 persons, the Shop Committee shall not exceed 7 employees. ARTICLE V— HOURS OF WORK 2.—Casual Employees: Revise Section 2 so as to clarify the status of casual em- ployees, having regard to the following principles: (a) Any employee who works less than three days during the week to be classi- fied as Casual for that week. (b) Performance of Casual Work shall not commence: (i) New period of Seniority retention. . (ii) New Lay-off coverage for purposes of Health and Welfare benefits. (c) Regular laid-off em- ployees called in for weekend clean-up work shall be paid at straight time. 3.—Bobtail Shifts Following Statutory Holidays: Amend Section 6 to provide for the bobtail shift to com- mence at midnight following a Statutory Holiday. 4,—Economic Use of Plant and Equipment: Provision for a negotiated work schedule within the framework of a seven-day continuous operation, to be instituted at the option of the Company. ARTICLE VIU—SAWMILL JOB EVALUATION 5. Establish a Job Evalua- tion Program in the Coast Sawmill Industry. ARTICLE XI STATUTORY HOLIDAYS 6. Add a new Section to provide that an employee who has participated in conduct contrary to Article XXVI (a) within a period of thirty (30) days preceding a Statutory Holiday shall not qualify for that Statutory Holiday. ARTICLE XiI— CALL TIME 7.—Where Work Commences: Amend Section 2 by add- ing the following provision of e and Female Minimum Wage Order No. 1 (1965): “Tf the employee commences work, four hours’ pay at the employee’s regular rate ex- cept where his work is sus- pended because of inclement weather or other reasons com- pletely beyond the control of the Employer.” 8. Add a new Section to provide that, notwithstanding any other provisions contain- ed in this article, the Com- pany will not be liable for the payment of call time where an employee on reporting for work finds no work available due to a contravention of Ar- ticle XXVI (a) by any person bound by this Agreement. ARTICLE XIV— FARE ALLOWANCE 9. Add a new Section to provide that where an em- ployee is laid off due to a con- travention of Article XXVI (a), the provisions of Article XIV shall not apply. ARTICLE XVI— HEALTH & WELFARE 10. Amend Section 3 to provide for an appropriate ad- justment reflecting the intro- duction of disability benefits under the Canada Pension Plan. 11.—5-day Emergency Clause Revise Section 2 (a) by the deletion of the word “plant”. 12. Add a new Section to provide that the application of seniority may be postponed by the Company where there has been a contravention of Ar- ticle XXVI (a). 13. Add a new Section to provide that an employee who participates in conduct con- trary to Article XXVI (a) shall lose his seniority and all rights and benefits accruing therefrom to the extent of one year for each day in which he has participated in the said conduct. This shall not inter- fere with the employer’s right to discipline or discharge for cause. 14, Amend Section 10 to provide full seniority rights to supervisory employees re-en- tering the bargaining unit equal to those rights enjoyed by Union Officials on leave of absence. ~ ARTICLE XXIV— RIGHT OF REFERENCE 15.—Limitation of Retroactivity: Add a new Section to pro- vide that in the event of a matter being referred to the Permanent Arbitrator under Article XXV, Section 1, the liability of the Company to make payment thereunder shall be retroactive for a per- iod not exceeding one year preceding the date of the award. ARTICLE XXVI— STRIKES & LOCKOUTS 16.—Amend Section (a) to read as follows: There shall be no strikes, work stoppages or activities which interfere with the main- tenance of normal production or services by the Union or its members during the term of this Agreement. 17.—Amend Section (b) to read as follows: The Union with its mem- bers expressly agree that there will be no activity with- ing the meaning of (a) above threatened, declared, author- ized, counselled, aided or brought about on its part. 18.—Amend Section (c) to read’as follows: In the event of any conduct within the meaning of (a) during the term of this Agree- ment the Union will instruct _ its members and ‘Officers who may be involved to cease such activity and comply with the terms of this Agreement. 19.—Add a new Section (d) to read as follows: There shall be no lockouts during the term of this Agree- ment. NEW OPERATIONS 20. That the parties to these negotiations sign the follow- ing letter of understanding: The Chairman of the IWA ~ Coast Negotiating Committee. It is further agreed that upon execution thereof the collective agree- ment shall be deemed to be dated from the date of the execution of the Master Agreement so that the new Agreement bears the same termination date as the cur- rent agreement.
