The golden qualities of man and
the dross of our social system were
broueht out in sharp contrast as publ
Canada watched the drama unfolded
recently at Magill Mine, Moose
River, Nova Scotia.

Weroic figures stalked the stage:
+he diamond driller who worked 2
‘stretch of seventy hours; the Stel-
Jarton miners who forgot sleep and
safety while drilling in 2 shaft that
was nothing but a four-sided coffin
threatening to close in on them on
any moment.

Tt would be pleasant if the story
<euld stop there.

But for the sake of reporting the
facts, and for preventing similar
things in the future, it is necessary
¢o turn the spotlight on other Tfig-

* res that played a role in the Moose
River tragedy.

The mime itself should never
have been looted and left in a con-
‘dition dangerous to life—and with-
out even a plan of its workings
registered in the mines depart-
yment.

Dr. Robertson should never have
had to be interested in gold mining.
The rewards of his profession, in
comforts and in prestige, should
Ihave been great enough to make
him independent of any other pur-
‘Suits. Doctors don’t have to go in
for gold mining in the Soviet Union.
That's a job for geologists, prospec-
tors, mining engineers.

‘And when the accident occurred,

Dwyer, and Angus MacDonald and
half a dozen other big business men
and politicians cluttered up the
scene and the headlines.

No wonder the rescue workers at
Moose River cried out against them.
Listen to the embittered verdict of
Billie Bell, the diamond driller who
worked a stretch of 72 hours with
only five for sleep to saye the en-
tombed: —

“There are too many bosses and
big shots around here,” he shout-
ed. “Here we worl our heads off
for days and nights, and finally
get the men located; then what
happens? Half the place starts
sivinge advice and the whole
thing will likely mean that these
three fellows down under will be
murdered while everybody argues
about what they are goimg to do.”

They say he only said this because
he was breaking under the strain.
You sit down and see if you can, in
full calmness, write as well as “ie
spoke: a paragraph that cuts
throush the bosses and big shots
with the relentless speed of his own
diamond drill.

A free press in Canada would
have backed up the miners and
drillers, cleared the ground, given
them elbow room.

But the capitalist press of Canada
had one concern and only one con-
cern: to cash in on the tragedy.
Extra sales and extra editions mean
better reports to the Audit Bureau
of Circulations—and so extra adver-
tising. So hour after hour they blew
hot and cold, raised hope, then fear,
interested only in keping the story
warm, regardless of the feelings of
the Canadian masses, to say nothin=
of the members of the families of
the entombed.

They would not, of course. have
displayed equal if any interest had
the men in the mine been workers.
For danger and death is the rou-
tine of the miners, loggers, con-
struction workers of Canada. An-
nually an average of over 1200
are killed and a nameless number

mutilated.

The interest aroused by the Moose
River tragedy must be-used to
break through this censorship. Now
is the time to press forward de-
mands for safety measures by and
on, behalf of the men who work
with death always at their elbows—
Some 1200 of them about to die in
the next year unless such a cam-
paisn is eonducted.—J. S. Wallace

S.U.P.A. SPORTS

Saturday’s S.U-P.A. sock and
squirm event was up to the usual
high standard. The bout between
Pat Johnson, 148 pounds (city), and
Jack Hogan, 145 pounds (S.U.P.A.),
won the ballot as the most popular
event of the evening. In the wrest-
ling events, Bill Chapman, 136
pounds (S'U.P:A.), and Mickey Mil-
liken, 140 pounds (city), put on one
of the fastest and most scientific
bouts seen around these parts. It
ended in a no fall draw.

Other events were:

Werestling—Stan Alford and Geo.
Wenderson, draw; Harry Hall, 145
pounds (V.H.A.C.), won a three-
round tilt from Jack Copeland, 145
pounds (Van.), with a fall in the sec-
ond round; Jack Robertson, 166
pounds (New West.), won from Bat-
Hing Storgan, 146 pounds (8.U.P.A.).

Boxing—Frankie Wagner, 128
pounds (S.U.P.A.), won from Jen
Linnett, 120 pounds (City); Ed Tay-
ler vs, Alex Smith, draw.

REGINA TRIAL
NOTES

Large delegations will go to the
Saskatchewan cabinet demanding
withdrawal charges and requestin=
government aid; have federal minis-—
ter of justice remit sentences im-
posed.

Petitions are being circulated on a
city-wide seale to have civic com-—
mission grant a tag day for defence
fund.

All country is rallying to the de-
fence. Vancouver today sent $50,
Toronto sent $75. These were two
Jargest of several sums received.

Within two hours of sentence be-
ing passed on Gallinger. others of
22 trekkers were delivering a new
bulletin throughout the city. In
part it reads, “Constable Gibbons,
R.C.M.P., main witness against Gal-
linger, Stevens and Mottl, has ob-
viously perjured himself on several
occasions. Yet when defence coun-
sel, P. G. Makaroff, applied for a
bench warrant to arrest this R.C.
M.P. for perjury, he was bluntly re-
fused and told to sit down.

Matt Shaw spoke to three paclk=d
protest meetings.

Mounties Lovock and Bailey, it
was intimated in court today, will
give evidence in every case. They
are the two who in plain clothes
trailed the trek leaders for weeks
before the Dominion Day riot. They
are the two who arrested HMyvans.
Their evidence is apparently to show
reason why police attacked—to ar-
rest leaders, and hence justify riot-
ing charges.

One Mountie who testified with
Bailey has been four times in strike-
breaking riots—Miussion Hill at Cal-
gary, Belleview, Blairmore, Regin:-.

Snuth, Fontaine, Clark, Lovock and
Bailey, and City Police Inspector

John Filavelle, vigilante member,
who testified against John Gallinger,
admitted that he was the one who
organized the local vigilantes. He
said he expected the riot three hours
before it happened went to work
melting lead for the “Star” so that
paper would be ready to run
“extras,”’

According to City Police Inspector
MacDougal, plans were completed
prior to mass meetings, to have four
van loads of Mounties and all pos-
Sible city police to conyerge on
speakers’ platform at the same time.
The purpose, he said. was to arrest
the leaders. Mountie stools said
they had no difficulty in arresting
Evans. MacDougal said when the
police swung out of the police gar-
age and headed for the platform,
they found all “peace and quiet-
nes,”” and the crowd made way for
them to get to the platform.

Hushed whispering among the
court room audience revealed in-
creasing resentment during Judge
MacDonald’s instructions to the jury.
The following remarks are excerpts
from his instructions:

“It seems to me that little dis-
erepancies as to time and distance
are not very material and only what
you would expect,” and “persons
lawfully assembled may become un-
lawfully assembled,”’ and again, “It’s
a pity that the city police did not
also wear steel helmets ...” Of
the attack on the meeting, the trial
judge said, “Didn't the police have
a right to be there as much as other
citizens ... I haye to tell you as a
maiter of law, even if the police
were conducting themselves in «4

peace .. .even that would not give
private citizens the right to attack
the police.” He also made severai
references to his disagreement with

points in the address to the jury
given by defence lawyer, P. G.
Makaroff.

This latter was one of the finest
ever heard in a western Canadian

court:

“There is far more at stake than
the liberty of this man,’’ said Maka-
roff. “It depends upon you to a
large extent to what extent police,
and they have force. may use that
force to yiolate people’s rights.”
“Isn’t it that the police did need-
lessly and without due reason pro-
voke the people tumultuously. They

are the assembly who disturbed the
people tumultuously and without
any need,’’ he said at another stage.

After drawing an analogy to the
attack on the meeting he placed to
the jury, “Whom would you expect
to find here, the accused or the
hoodlums who made that sudden at-
tack, and that on the fundamental
rights of British people, the rights
of free assembly and free speech,
Did not they (the police) anticipate
trouble, deliberately anticipate
trouble, provoke trouble? One man
could have served the warrant on
Evans.”

Turning to the eyidence of Gib-
bons, Makaroff said that Gibbons
in pleading he did not recall certain
things had ‘t‘aken the last refuge of
a liar.’ Gibbons is trying to pin that
weapon (piece of iron piping) on
this man out of his imagination,
purely and simply. Weedin acted
in self-defence, and when he failed
in self-defence, he came out bleeding
profusely, and whatever he did he
was justified. I submit that you
cannot fail to place the whole blame
for what followed upon the police,”
said Makaroff, concluding, “Had the

MacDonald Says Rate is
Ridiculously
Low

VANCOUVER, B.C., April 28 —
Taking advantage of the “Jubilee”
atmosphere, the city aldermen at
Mondays meeting of the Council
made a move to increase their
wages. The debate was postponed
to a special meeting Wednesday.

Coming as it does at a time when
thousands of relief workers are fac-
ing evictions because of their in-
ability to meet rents, the action of
the city fathers is interesting.

Alderman MacDenald started the
argument. He said the present rate
of $999 per year “is ridiculous’ for
the “serious strain of being an al-
derman during the depression.”’ He
moved that the rate be raised to
$1800 per year. which, allowing for
the salary cuts taken by other em-
ployees, would leave a net wage of
$1539 per year. Alderman H. D.
Wilson, 30-year-old member of the
eouncil, probably visualizing for the
moment the thousands of young
men drawing “high” wages of $15
per month, supported Alderman
MacDonald. :

U.S. Loggers Pledge Support

Never before has the enthusiasm
been so general, nor the opportunity

and Oregon have pledged full sup-
port. Should a strike be necessary
here, not one log will find its way
from Washington or Oregon into
B.C. mills. The unions there (are
strong) have pledged ample financial
support. A. Muir, International
representative for District 6 of the
United Brotherhood of Carpenters
and Joiners, is taking part in the
activities of the council here, and
has pledged full support from his
office.

workers of Oregon and Washington

The boss loggers realize, once
properly organized, the loggers would
be able to stop the plunder. The
attack against the Lake Cowichan
loggers was their first wedge in the
plan to smash the union and pre-
vent unity with the 50,000 loggers
of Washington and Oregon.

the Lake Cowichan trouble, absorp-
tion into the A.F.of L. has proceed-
ed. and Washington and Oregon are
ready to help you.

The Gallinger Trial

The police attack on the market
square meeting staged here by the
On-to-Ottawa Trekkers, Dominion
Day 1935, was previously planned
and the~plans detailed on a blue
print were submitted prior to the
attack by R. ©. M. P. Inspector
Mortimer at a joint conference with
heads of Regina police. This in-
formation was wrung from Regina
police senior inspector MacDougall
during searching defence cross ex-
amination today, when trials re-
sumed of 20 trekkers and two
Reginans being tried on charges of
rioting arising from the smashing
of the admittedly peaceful meeting.

Another witness for the prosecu-
tion, John Flavelle, said that he ex-
pected the riot three hours before it
occurred, and went to work melting
lead for the ‘Star,’ where he is
employed, so that the paper would

On the eve of his departure to
England, Colonel W. W. Foster,
chief of the Vancouver police force,
was granted a $1000 present, to ap-
ply as a bonus on last year’s salary.
This was the decision made at 2
recent secret meeting of the police
commission. The public announce-
ment was made by Mayor McGeer
followings the meeting, but the story
leaked out in rumors around the
police station-
The chief was also given an in-
crease of $92.20 per month, retro-
active from January 1. This, allow-
ing for the two pay cuts, gives the
ehief a net wage of $5,338.63 per
year, or $444.88 monthly.
Originally the pay increase was
made retroactive to January 1, 1935,
when the chief toolk,office, but after
it was explained by civie officials
that no provision had been made in
the 1935 budget for a salary raise,
and the budget was now closed,
other arrangements for the “sift’’
to the chief had to be made. Hence
the $1,000 bonus.
Chief Foster was also given a
two months’ holiday. During the
months ‘of June and July he will
visit the Old Country. It is his in-
tention to study police methods of
Seotiand Yard and Paris.

Negotiations

Will Make Every Effort
