Section 215 of the Land Title Act provides that there may be registered as a charge against the title to the land, a covenant as therein authorized, whether of a negative or positive nature, in favour of a municipality or the Crown; on There is a certain hallway which runs from the entry of the house to the basement that is 822 millimetres in width, {the “Hallway") while the required width, according to British Columbia Building Code, Section 958, is 860 millimetres; De The Covenantee has agreed to permit on the Lands the Hallway that is 822 millimetres on the terms and conditions of this Agreement. NOW THEREFORE, in consideration of the premises and the mutual covenants and agreements of the parties herein contained and of the sum of ONE ($1.00) DOLLAR now paid by the Covenantee to the Covenantors (the receipt and sufficiency whereof is hereby acknowledged by the Covenantors), the parties hereto ‘do hereby covenant and agree with the other as follows: : 1. | The Covenantors acknowledge that the width of the Hallway is 822 millimetres. . 2- ‘The Covenantee acknowledges and agrees ‘that the width of the hallway is 822 millimetres and that the Covenantee has ho plans to.take any action to compel the Covenantors to extend the width of the hallway to comply with Section 958 of the Building Code adopted pursuant to the British Columbia ‘Building Regulations. 35. The Covenantors covenant and agree that notwithstanding. paragraph 2 hereof, the Covenantee shall retain all its rights_ pursuant to the British Columbia building code Se ection 958 and nothing contained or implied herein snail prejudice or affect the rights and powers of the Covenante in the exercise of its: function under any public and private statute, by-laws, orders and regulations, all of .which may be full and effectively exercised in relation to the said lands as if this Agreement had not been executed and delivered by the Covenantor. fa NOL
