Proposed Covenant over Lot 43 of Genstar Phase 8B Subdivision
(Public Works Committee Meeting Jan 3, 1990)

Recommendation:

That the Mayor and City Clerk he authorized to execute the attached
Restrictive Covenant for lot 43 in the Genstar Phase 8B subdivision.

Background and Comments:

The attached Section 215 Restrictive Covenant is intended to alert future
owners of lot 43 of the Genstar Phase 8B Sukdivision that there is a potential
slope stability problem at the south end of the lot. Over the past year or so
fill has been dumped over the original top of the embankment to make the rear
yard of lot 43 more level and to reduce the slope of the embankment. It is
Gifficult in the field to determine where the original edge of the embankment
was. Genstar's soil's consultant has studied this area and recommends a
certain area at the rear of the lot not be built on. The attached Covenant
reflects this recommendation.
