that the Encroachment will not be damaged by the exercise by
the Covenantee of any of its right pursuant to the Statutory
Right-of-Way and the Covenantor agrees to save harmless the
Covenantee in the event of any damage being caused by the
exercise by the Covenantee of any of its rights pursuant to
the Statutory Right-of-Way.

4, It is mutually agreed and declared by and between
the parties hereto that the covenants herein contained shail.
be covenants running with Lands and that none of the cove~
nants herein contained shall be personal or binding upon the
parties hereto, save and except during the Covenantor's
seisin or ownership in the Statutory Right-of-Way, and with
respect only to that portion Statutory Right-of-Way of which
the Covenantor will be seised for which he will have an
interest, and that the Lands shall, and nevertheless, be and

remain at all times charged therewith.
