A2 - The Terrace Standard, Wednesday, July 27, 1994 Vehicle pulled from river Accident still a mystery TERRACE RCMP have so far been unable to determine why a car drove into the Skeena River near Cedarvale June 10, drowning two south Okanagan residents. “Right now the results from the autopsy (of the driver) and the mechanical inspection give us no cause for the accident,”’ Staff Sergeant John Veldman said last week. “TI don’t know if we'll ever be able to come up with a rea- son why the car left the high- way,”’ he added, Drowned were Franklin Augustus Wheeler, 63, fom Westbridge and Patricia Louise Leir, 63, from Kaleden. run off time and treacherous diving conditions prevented the removal’of the car and pas- sengers from the river bed un- til last week. A large crane was able to lift the vehicle out of the river life in jail A 26-YEAR-OLD Terrace man was found guilty of second de- gree murder by a Supreme Court jury here last week. Dwain Elliot Taylor received a life sentence with eligibility for parole in 10 years for the murder of 31-year-old Gale Annette Mor- rison, a Spruce Street group home resident. Her body was found in a wooded area near Col-Smith Road in ‘Thornhili on April 11, 1993, A forensic pathologist from Vancouver told the court that an | autopsy of Morrison's body showed extensive skull fractures caused by ‘‘very severe force.’” The pathologist said she believed Morrison had received four blows to the head but the first blow had !eft her uncon- scious. Defence lawyers Dave Warner and Holly Grneger argued that the charge of second degree mur- der should be reduced to mans- laughter. Based on testimony from Taylor, Warner said Taylor hed been provoked because Morrison had kicked him in the groin. The alleged kick occurred after the two had met on the street in the morning of April 11, 1993, Taylor told the court, They talked for a while and then decided to go to a nearby wooded area lo have sex, Taylor said. Whea the two were getting dressed, Taylor told the court, he handed Morrison her jacket that was dirty from being on the ground. She was angry about the dirt on her jacket, according to Taylor, so she kicked him in the groin. He didn’t mean to hurt her, Taylor told the court, but he said he just ‘went berserk”? when she kicked him. A charge of second degree mur- der can be reduced to mans- laughter if it can proven that the accused acted ‘'in the heat of pas- sion caused by sudden provoca- tion,” according io the Canadian Criminal Code, Crown prosecutors argued the charge should remein as second degree murder because there was no testimony or evidence to back up Taylor’s claim he had been kicked. The water was too high and there was virtually zero visibility. It was simply too dangerous for our people to go down there and recover the vehicle,’’ said Veldman of the periad between the accident and the time the vehicle was recovered. The autopsy ruled out the possibility the driver suffered a heart attack and further tests have been ordered. “Something in the tests may be able to give us a contribut- ing factor,”’ said Veldman. “There waS mo reason we High water during the June know of for the vehicle to leave the highway. There was not a passing situation, noth- ing,’” he said. - Veldman added that an eyewitness to the accident told police the vehicle simply left the road. vale June 10 was recovered by divers and a crane last week.
