4 By-law to authorize the City to enter into Land Use Contract No. 17,
FERPEAS the "City of Pore Caquitlan Zoning By-law, 1965, No. 918"
as arzonded designates certain areas of land within the zones eet out

therein as "Developzent Areas"; :

AND MEEPEAS the lands hereinafter described are aituate within an

avea so des{gnated;

ai) WEEREAS the Owner of the said lands has nade application for a
Land Use Centrace to authorize works, development, and use some aspecta
of which are not in conforaity with the Televant City By-laws as the
saze apsly to the zone fn which the said lands are situate;

AUD RURREAS the Council has given due regord to the following
considerations:
1 (a) the promotion of bealth, safety, convenience and welfare of
the public.

{b) the prevention of the overcrowding of land, and the preservation
of the ancnities Pareicular to any zone,

(c} the securing of adequate light, air aad access,

(4) the value of the land and ‘the nature of its present and prospective
use and occupancy.

(ec) the chacacter of cach zone, the character of the buildings already
erected and the peeulfar suitability of the zone for particular use,

{f) the conservation cf Property values.

“(a) the developnent of areas te Promote greater effictency and quality,
(b) the irpact of developzent on present and future public costa,
(c) the betterment of the environment,
the fulf{lizenc of community goals.

(e) the provisi{on of necessary publle space,
and it is deexed destrable to enter into Land Use Contract No. 27 in the form
and to the extent heretnafter Provided;

FORE the Municipal Council of The Corporation of the City of Por

Caquielan, fa open meeting assenbdled, enacts as follows:
1. The Counctl of The Corporation of the City of Port Coquitlam ts hereby
authorized and cnpowered to enter into a Land Use Contract With Florence

Hytrote of 2156 Prairie Avenue, Pore Coquitiam, B. C., and Frank Yerio

Kismel and Mary Mildred Kimmel of 2032 Suffolk Avenue, Port Coquitlam, B.C.,

2. The sald Land Use Contract No. 27 shall extend to and shal) regulate the
development and une Of the lance deseribed ast
Lot 82, Block 32, District Lot 464, Group One,
Plan 46962, New Westminster District.
3. Liad Use Catract No. 17 shall have the force and effect of a restrictive
covenant running with the land described in Section 2 hereof and shall be
registered in the New Westminster Land Registry Gf£ice by the City.
4. By-law No, 1287, cited as the "Land Use Contract No. § Autherization
By-law, 1973, No. 1287" ig repealed,
