was advised that the Property was zoned CS-1 and as such this
zoning would allow the construction of a restaurant on the
Property. On the strength of that advice I purchased the
Property to develop it in accordance with the zoning. I was
advised by the staff of the Corporation of the City of Port
Coquitlam that they would be pleased to see a restaurant
developed on the Property.

In the final months of 1976 I retained the services
of Mr. Dan Tolentino, a professional architect. In accordance
with what I have been led to believe is the standard procedure
of the Corporation of the City of Port Coquitlam for the
issuance of a building permit Mr. Tolentino did at my request
Prepare and submit to you as required, preliminary drawings
for the development of the Property. When the preliminary
drawings were submitted your planning department confirmed
that the zoning in the area was appropriate for the construction
of a restaurant on the Property. Preliminary approval was
given in late November or early December, 1976 and I. accordingly
instructed my architect to prepare the required detailed’ drawings
which encompassed the changes required by you at the time of
preliminary approval,

Architectural drawings were submitted on January 21,

‘1977.

Further structural drawings were submitted on February
22, 1977.

Io understand that the Corporation of the City of Port
Coquitlam has no form upon which an application for a building
permit can be made but as a matter of practice treats the
drawings that are submitted for approval as the application.

I believe that all steps required to be taken by me
for the issuance of building permit have been done. I understand
the policy of the Corporation of the City of Port Coquitlam to
be that all fees required under the By-Law to be paid for building
permits are calculated by you at the time the permit is to be
issued. Accordingly, we enciose a blank cheque payable to the
Corporation of the City of Port Coquitlam and ask that you
calculate the required fees, and that you complete the cheque
accordingly. As I have complied entirely with the By-Laws of
