Moved by Alderman Gates: Seconded by Alderman Keryluk: THAT City Council direct the Clerk’s Office to inform surrounding property owners of this application and to place the following resolution on subsequent agenda of City Council. AND THAT City Council adopt a resolution to grant a Development Variance Permit to Lot 5 of D.L. 233 NWLD Plan 79828 for relaxation of the rear yard set back requirement of the Zoning Bylaw No. 2240 Section 802, RS-2 Small Lot Residential, Subsection (6) Rear Yard to permit an encroachment of a deck. From the Director of Building Permits and Inspections July 13, 1989 regarding a proposed covenant for 1078 Yarmouth Street. Moved by Alderman Keryluk: Seconded by Alderman Gates; That the covenant presented this evening regarding installation of a sewage pump at 1078 Yarmouth Street be approved; AND THAT his Worship and City Clerk be authorized to sign the said restrictive covenant on behalf of the City and to affix the City corporate seal thereto. Carried. From the City Clerk/Deputy City Administrator, July 14th, 1989 regarding a latecomer Charge Waiver Agreement for Genstar Phase 11 (S#8/89). Moved by Alderman Gates: Seconded by Alderman Keryluk: At the request of and pursuant to the Agreement with Imasco Enterprises Inc. dated the 12th day of July, 1989, BE IT RESOLVED that the works and services described in the aforesaid Agreement and installed or to be instalied by the said Imasco Enterprises in connection with the development of the lands described as: That portion of Lot 9, Plan 68514, D.L.'s 232, 340, 341, and 344, Group One, N.W.D. shown on a survey plan signed by Robert M. Reese, B.C.L.S. and dated July 4th, 1989; are hereby conclusively deemed to be for the sole benefit of those lands and that none of the cost of providing the said works and services shall constitute “excess or extended services” as defined by Section 990 of the Municipal Act. AND THAT the aforesaid Agreement be and the same is hereby approved and that the Mayor and City Clerk are authorized to sign the same on behalf of the City and to affix the Corporate seal thereto.
