{ 1 4 | | | { i } | | eee Stee eres AND WHEREAS Section 215 of the Land Title Act R.S.B.C. 1979, c. 219 permits the registration of a covenant, whether of a negative or positive nature, in favour of the City, as a charge against the title to the Land herein defined arid is enforceable against the Grantor and his successors in the title even if the covenant is not annexed to the Land owned by the City; AND WHEREAS the City Council desires the Land to be used only for the purposes of a Golf Course including a clubhouse and other ancillary uses; ; NOW THEREFORE in consideration of $1.00 and of the premises and of other good and valuable consideration the parties agree as follows: l. The Grantor hereby grants this covenant for registration as a charge against ALL AND SINGULAR that certain parcel of land situate in Port Coquitlam, British Columbia which is more particularly described as: Lot 21 Section 5 Block 6 North Range l East New Westminster District Plan” - so (the "Lana*). 2. The Land and all buildings on or to be erected on the Land shall: (a) ke uzed solely for the purposes of a golf course including a clubhouse and other ancillary uses; (b) not be used or built on in any manner that would interfere with the City's ability to improve certain adjoining land known as Freemont Street should the City for any reason at any time decide to develop that land asa highway. 3. The Grantor acknowledges that the City may in the future decide to develop Freemont Street as a highway and that it presently intends to do so should further development on Burke Mountain in the Municipality of Coquitlam or elsewhere render the highway presently known as Coast Meridian inadequate in the City's opinion to serve transportation needs. 4. The Land shall not be subdivided without each proposed subdivision first receiving the approval of the City. 44
