au COWPORATION OF TINE Ge GP PORT COQULTLAN BYot ea NO. 1373 A By-law to authorize the City to enter into Land Use Contract No. 11 WHEREAS the “City of Port Coquitlam Zoning By-lav, 1969, No. 918" as anended designates certain areas of land within the zones set out therein as “Development Areas"; AND WHEREAS the lands hereinafter described are situate within an ares so designated; * AND WHEREAS the Owner of the said lands has made application for a Land Use Contract to authorize vorit, development, and use some aspects o£ which are not in conformity with tle relevant City By-laws as the same apply to the zone in which the said iands are situate; AND WHEREAS the Council has given due regard to- the foliowing considerations: 1. (a) the promotion of health, safety, convenience and welfare of the public. - (>) the prevention of the overcrowding of land, and the preservation of the amenities particular to any zone. : (e) the securing of adequste lighc, air and access. (a) the value of the land and the nature of its present and prospective use and occupancy. (e) the character of each zone, the character of the buildings already @rected and the peculiar suitability of the zone for particular use. the conservation of property values. the development of areas to promote greater efficiency and the impact of development on present and future public costes. the betterment of the environment. the fulfilinent of community goals. the provision of necessary public space. and it is deened desirable to enter into Land Use Contract No. ll. ain the form and to the extent hereinsfter provided; NOW THEREFORE the Municipal Council of The Corporation of the City of Port Coquitlam, in open meeting assembled, enacts as follows: 2. The Council of The Corporation of the City of Port Coquitlam is hereby authorized and empowered to snter into a Land Use Contract with : <4 4 ti. C. in the form and to the extent set forth in “Land Use Contract No, 11", which {8 the Schedule hereto annexed and made part of this By-law. 2. The said Land Use Contract No. 11 shall extend to and shall regulate che development and use of the lands described as: i, Lot 41, District Lot 465, Group One, Plan 25135, New Westminster District, Except Part Subdivided by By-lav Plan . Lots 4-10, inclusive, Block One, District Lot 465, Group One, Plan 2364, New Westminster District. All that Portion of Ferth Street of District Lot 465, Group One, New Westminster District as shown dedicated on Registered Plan 2364 included within the green outline on a By-law Plan prepared by V.C. Goudal, B.C.L.S., and dated March llth, 1975, 1, copy of which said Plan was attached to and made part of the “Perth Street Plan 25135 Highway Exchange By-law, 1975, No. 1368 of The Corporation of the City of Port Coquitlam. (Wow known as Parcel , (By-law Plan ), District Lot 465, Group One, New Westminster District, Plan 2364.) 3. Land Use Contract No. 11 shall have the force and effect of a restrictive covenant runitug with the land described in Section 2 hereof and shall be tegistered in the New Westminster Land Registry Office by the City. 4.
