Louise S. Kiss 909 Richmond Place Port Coquitlam, British Columbia V3B 2M8 (604) 941-3671 September 23, 1993 Mr. Brian Kirk City Administrator City of Port Coquitlam 2580 Shaughnessy Street Port Coquitlam, British Columbia V3C 2A8 Dear Mr. Kirk: Further to our telephone conversation of September 22, 1993, this is to report the facts surrounding the damage caused to my property arising from the storm of September 12. As we discussed, you will present this to City Council for review. My home backs on to Hyde Creek Park which, as you know, is heavily wooded. Unfortunately, the storm of September 12 caused trees to fall onto my backyard causing damage to my fence, pool and shed. An initial estimate places repair costs at approximately $800. I believe that as the trees are the property of the City of Port Coquitlam, the City should be respcusible for covering these costs. Relative to this, I would like to emphasize that the trees that fell were about 80-100 feet high, had not been topped by the City to minimize potential wind damage, and appear to have been planted close to the creek in unstable and moist soil conditions. (This also raises the question of similar incidents occurring on the future now that the roots of adjacent trees may have been loosened, and especially as these trees also should be topped.) From my discussions with the City's Purchasing Manager, Mr. Terry Day, it is ry . understanding that the Municipal Insurance Association has declined any responsibility to reimburse claims arising from storm damage. I subsequently met with the Superintendent of the Parks Commission, Mr. Bram Hoogendoorm, and he advised me that this issue was not something that could be addressed by the Commission. I must, however, acknowledge that Mr. Hoogendorm was very cooperative and that he arranged to have the fallen trees and related debris removed from my yard. LITEM 38
