VICTORIA (CP) — An in- quest jury considering the death of a 10-hour-old baby must be careful with its ' recommendations because they have a potential to go to the roots of Western society, British Columbia's chief coroner sald Wednesday. Dr. William McArthur made the comment in. the case of a Victoria infant who died after his birth by cesatian section Sept, 16, 1978 to a 33-year-old severely-retarded woman, who was betweén 23 and 25 weeks pregnant. The inquest was told last week that a fetus would only have a 15 per cent chance of surviving such an operation at that stage of pregnancy. MacArthur told the jury just before it retired to review the case that “it is blindly clear that the recommendations you make have a potential to go to the roots of our society in the way we live and treat these very serious matters.”* “Your findings and recom- mendations will be taken very serious,” he told them, warning them nat to allow Jury told to take care, very roois of our | society at risk Mitigation or dilutions af their findings out of aym- pathy for any person or pers Victoria hospital directors had told the inquest through their legal counsel that the issue of aborting a child before the fetus is 1¢-weeks- old or after 30-weeks-old should be a matter between a patient and her doctor. Rodney Taylor, the hospital’s lawyer, said leaving the decision about abortion to the two ies at those stages would remove the vast majority of ap- plications before - the hospital's therapeutic abortion committee and allow it to more closely consider remaining cases. He also said directors were concerned about the vagueness of the Criminal Code with respect to abor- tions and they would prefer a more definite stance even at the logs of flexibility. ‘He said the only detailed reference in the code to abortion is lnked to description of the committee and no mention is made of “procuring the miscarriage of a female person,” Barry Browning, repfesenting the woman's mother, said there was ‘no one to speak for the fetus and asked the to consider recommen that a lay person act as its advocate on therapeutic abortion com- mitlees, A. D, Thackery, . who represented five doctors involved, ssid all tried to do their best in handling’ the case. He said 11 professionals had agreed that the pregnancy should be terminated. Chris Randall, representing the public trustee, said the jury must consider whether continuing the pregnancy would have endangered the mother’s He complained there was nm) definition of care or treatment of mentally- retarded persons and said the government should clearly define who has authority for care If it delegates responslbility, , &uce VICTORIA (CP) — Ab- botsford farmer Henry Friesen and Social Credit MLA Bill Ritchie have ended their fued, but the RCMP commercial crime section isn't quite ready to let the issue die. Ritchie told a news confer- Wednesday that Friesen, a member of the party'a local executive in Kbbataford, has agreed to withdraw a signed affidavit that sald Ritchie offered to we influence to get a five- acre plece of property out of the agricultural land reserve in return for political king. Ritchie, MLA for the area, said that in return he will not oceed with a threatened wault against Friesen for the comments he made, The agreement was worked out in a private meeting following a stormy .constituency meeting in Abbotsford Tuesday. Newspaper reporter Frank Klassen, who wit- nessed an agreement the two men signed, sald Friesen decided he had mistakenly taken Ritchie's offer of help in the land freeze as e bribe. However, RCMP Supt, BR. N. Mullock sald Wednesday pga oy . The Herald, Thursday, October 18, 1977 Page 7 police will continue to in- vestigate Friesen's allegation. The Supreme Court of Canada ruled Tuesday that the government went through the wrong court system in its move to gain possession of the property of George and Evelyn Jackson for expansion of the Van: couver International Air- port. The judges stated that the Federal Court trial division which gave the government possession of the property and the Federal Appeal Court, which upheld the decision, lacked jurisdiction. The case should have been heard in the British Columbia Supreme Court, they said, Lawyer Charles Johnstone said Wednesday he hopes to have the whole thing stepped by Clark, “We sent him a celegram today asking him to make sure the transport pecple don't start litigation all over again and to settle this thing by negotiation,” he said, Similar appeals have gone to Environment Minister John Fraser, MP for Van- couver South, and to ’ Transport Minister Don Mazankowski.
