equal or similar to that of the Lands, the City shall,
at the request of the Developer, cancel a right of way
granted or to be granted to the City on or adjacent to
such property lines to permit such right of way area to
be filled in 50 as to maintain, inter alia, the
aesthetic appearance of the area as a whole, provided
that such right of way is no longer necessary to
preserve the effective drainage of the lands adjacent

to the right of Way.
