Kirk June 13, 1990 City Administrator File No. 25/90 duh 25 1990 FROM: Carlos Felip Director of Planning RE: Hawthorne Lodge — 2111 Hawthorne Avenue Application for Development Variance Permit Planning and Development Committee - June 19, 1990 RECOMMENDATION: It is recommended that the Planning Department be authorized to draft Development Variance Permit 25/90. BACKGROUND: The Hawthorne Lodge was developed under the provisions of a Land Use Contract. In the last few months, the Lodge applied and obtained Council approval to amend the Land Use Contract to permit the construction cf an elevator for the building. When the amendment of the Land Use Contract was submitted for registration to the Land Titles Office, our Solicitors were informed that the contract had never been properly registered. Due to changes in legislation, it is no longer possible to register the Land Use Contract. This situation makes the Hawthorne Lodge a legal non-conforming use: The current zone cf the property, P-2, would not permit a structure as tall as the main building of the Lodge. The Lodge administrator, has, therefore applied for a Development Variance Permit to correct the non-conformity of the building. COMMENTS FROM OTHER DEPARTMENT: The Engineering, Building, Parks and Recreation and Fire Departments have no objections tu the issuance of this Development Variance Permit. DISCUSSION: This Development Variance Permit will make fully conforming a building that beceme legal non-conforming due te administrative problems.
