{ a Coquitlam, in the Province of British Columbia, being more par- ticularly known and described as: Lot 2 District Lot 340 Group 1 Plan 72143 New Westminster District (hereinafter called the “lands"). B. The Owner has granted to the City an easement over the said lands to facilitate inter alia the construction and maintenance of water and storm sewer works on the lands and which easement was filed in the Land Title Office in the City of New Westminster under number 2123630 (herein called the "easement"). on The easement provides Inter alia that the Gwner shall not erect or maintain any building or other structure on the statutory right-of-way covered by the easement (herein call the "easement area"). Dd. The Owner has constructed a retaining wall on the easement area contrary to the terms of the said easement. E. The City has agreed that the Owner may maintain the retaining wall on the easement area and the Owner has agreed that no other structure, building, wall or foundation shali be built on the easement area. F. The Owner has agreed to enter into a covenant in favour of the City registrable under the provisions of section 215 of the Land Title Act, R.S.B.C., 1979, chapter 219 on the terms hereinafter set forth.
