Criggie Chief Licence Inspector & Bylaw Enforcement Officer Mr. Fitness (Olympia Fitness) Revoking of Business Licence 91001508 (invoice #4825) That Council revoke the business licence no. 91001508 (invoice #4825) issued in the name of Mr. Fitness (Olympia Fitness) located at Unit 9 - 1760 McLean Avenue, Port Coquitlam, BC. That Council not issue a business licence to Mr. John A. Myles, owner of Mr. Fitness (Olympia Fitness) to carry out a retail or wholesale sales business in the City of Port Coquitlam during 1991. This report is submitted to Council for consideration at the hearing scheduled for Monday, June,24, 1991 on the proposed revocation of business licence no. 91001508 (invoice #4825), issued to Mr. John A. Myles to operate as Mr. Fitness (Olympia Fitness). Mr. Myles carries on business as Olympia Fimess or Mr. Fitness, manufacturing fitness and gymnasium equipment. In late 1990, the Bylaw & Licencing Department began receiving complaints from Mr. Myles’ customers, concerning his business practices. Initially, we encouraged the complainants to attempt to resolve their difficulties through the agencies which usually deal with customer relations problems (including the Better Business Bureau and the Ministry of Labour and Consumer Services). However, the complainants have advised us that those agencies are unwilling or unable to take ariy action. | A number of Mr. Myles’ customers have also taken court action against him, mostly in the Small Claims Division of Provincial Coust. Included with this report are copies of court documents forwarded to the City by complainants. Almost all of the complaints and all the court actions are based on allegations that Mr. Myles has taken deposits for equiprnent to be delivered, then failed to deliver the equipment or to return the deposits. Most of the court actions have resulted in judgments against Mr. Myles, either after trial or by default. _
