Page A& — Terrace Standard, Wednesday, October 3, 1990 Dump fire charges laid TERRACE — The Bulkley- Nechako regional district has been charged with pollution violations at the Burns Lake city dump. Environment minister ‘John Reynolds announced’: the charges last week in. Terrace, and reaffirmed the ministry’s commitment Lo prosecute all en- vironmental violators. ‘No one is -immune,"’ Reynolds said. ‘“There are a number of cases out there where the fines could be’ the max- imum.’ The Bulkley-Nechako regional district is to appear in court Oct, 17 on three counts — carrying maximum fines of $1 million each — of violating waste permits in connection with a series of burning in- cidents last year at the Burns bake landfill. Styrofoam and other materials designated as special wastes are alleged to have been burned. A regional district director said it’s difficult to prevent peo- ple from dumping household hazardous wastes which range from paint cans and cleaning fluids to solvents and pesticides — at the landfill. All such hazardous wastes are.sup- posed to go io environment ministry depots, and the only | is in ! one in’ the northwest Smithers. “It’s ridiculous that someone from Burns Lake with an old battery or a few cans of paint should be expected to drive to Smithers,” Mickey Bisanz said. Terrace residents face the same problem of having to drive two hours to dispose of their special wastes. Reynolds noted that ihe ministry helps pay for special waste collection days, which can be arranged in areas other than Smithers. Bisanz said even gyprock is classified as a special waste, putting cities and regional districts at risk of prosecution when it’s dumped in landfill sites. Fish sale investigated SMITHERS — The Depart- ment of Fisheries and Oceans (DFO) is contemplating charges after a Moricetown native man staged a commercial fish sale in Smithers Sept. 13. Moricetown band chief Adam Gagnon sold seven sockeye salmon, two steelhead and a coho to Telkwa resident Richard Overstall just outside the DFO office in Smithers. Overstall bought the fish off the - back of Gagnon’s pickup truck for $100 in defiance of federal fisheries officers, who videotaped:the:transaction. .... “> Charges could. be submitted to prosecutors for approval as early as this week if sufficient evidence exists, said DFO district assistant supervisor Laurie Gordon. Natives -staged the event as part of a continuing drive to win the right to sell fish commercial- ly. They say they will argue rivers flow- ing through reserves aren't ac- tually part of the reserves, and therefore the bylaws can never apply. Gitksan-Wet’suwet’en hereditary chiefs’ spokesman Don Ryan said fisheries officers actions are aimed not at enforc- ing laws, but at keeping natives out of the commercial fishery. “How can they restrict our markets and set allocations withoul our having a say?” demanded Ryan. The hereditary chiefs are setting up markets for native fish sales in North America, the Orient and Scan- dinavia, he said. He said natives will take the issue to court, regardless of whether charges are laid against Gagnon and Overstall.
