} The proposed amendments to the Municipal Act, R.S.B.C. 1979, c.290 are presented below: I. Section 262 is amended as follows: (a) "The Council shall protect, defend and indemnify an officer or employee ot Municipality or a Member of its Council, where..." by adding to subsection (1): "except for criminal fines arising under the Waste Manageme Environmental Protection Act, the Fisheries Act and other similar environmental legislation where the officer, employee, or Member of Council, has not acted willfully contrary to the terms of his employment or has acted on the instructions of a superior.” by replacing subsection (3) with the following: "(3) The Council shall not seek indemnity against an officer, employee, or Member of Council, in respect of any action of the officer, employee, or Member that results in a claim for damages against the Municipality, but the Council may seek indemnity against an officer, employee, or member, or where, in relation to the action that gave rise to the claim against an officer or employee, the. officer or employee willfully acted contrary to: ae (a) the terms of his employment, or (b) anorder of a superior o I. | ‘Section 755.1 is amended by replacing subsection (3) with the following: "(3) Subsection (1) does not provide a defence where . a Cy (a) the municipal public officer has, in relation to the conduct that is the ves subject matter of the action, been guilty of dishonesty or malicious or willful misconduct, or ol - oe ae (b) the cause of action is libel or slander."
