LEGAL DESCRIPTION: Lot 66, Block E, NE 1/4 of Section 6, Township 40, Plan 19853. BACKGROUND The duplex in question was constructed in 1968 together with two other adjacent duplexes. Consquently, it cannot meet all the duplex requirements in the Zoning By-law No. 918 adopted in 1969, in that the 600 foot distance between duplexes cannot be satisfied. This duplex is therefore considered as legal non-conforming. It is necessary to note that if this duplex is damaged structurally in excess of 75% of its value above its foundation, the property will have to be reverted back to single family residential use. RECOMMENDATION: This application was dealt with by the Planning and Zoning Committee on March 22nd, 1977. The Committee is of the opinion that it cannot support the conversion of a legal non-conforming duplex and therefore recommends that the application be denied.
