Error in Assessment - 1565 Pitt River Road In the course of reassessing the above mentioned property the Assessment Department has discovered an error in calculating property assessment. There was an error in the measurements of the building which has resulted in a higher assessment than should have been applied to the building. The Assessor has applied to the Assessment Commissioner's Office in Victoria under Section 40 of the Assessment Equalization Act to have the error corrected for 1974, however, the owner has contacted the Mayor with a request that the City adjust taxes for 1972 and 1973. The overpayment has been calculated and would amount to $18.06 for 1972 and $27.88 for 1973. It is possible for the Council to apply for permission to rebate these taxes by application to the Lieutenant Governor in Council. The relevant legislation in connection with the assessment roll is set out below and you will note that the confirmed assessment roll is binding on all properties concerned notwithstanding any errors or defects. In other words : the procedure is just as binding on the City as it is on the taxpayer in that E the City cannot go back and recover taxes that might have been lost through an error in assessment. Therefore, in general, errors such as this are not subject : to correction. As stated above, however, it would appear that if the Council desired to make some adjustment that there is the process of obtaining approval from the Lieutenant Governor in Council. The Mayor has asked that the matter be considered by Council to see if they wish to pursue an adjustment. 2. Land For School Construction I have received a letter from School District #43 asking if Council would consider a sale of some land for future school construction. The two sites involved are (1) land on Coquitlam Avenue adjacent to James Park School site and (2) land on Reeve Street for a proposed school to service the town centre Both of these sites have been the subject of discussion of Council in the past and the land on Coquitlam Avenue is actually reserved by resolution of Council for sale to the School Board. The Board advises that they now have permission from the Department of Education to purchase these properties. o+-/2
