Eng., City Engineer Subject: Multi-Party Agreement for Sewerage Works-Westview/Genstar (Public Works Committee Meeting June 20, 1989) RECOMMENDATIONS : That the Mayor and City Clerk be authorized to execute the attached agreement for the construction of sewerage works, to service the Westview Heights and Genstar Lands, located at the southwest quadrant of Mary Hill. BACKGROUND AND COMMENTS : At the time that the Westview Heights Rezoning was finally approved by City Council last year, several commitments were made by the developer, Western Mortgage Company Ltd.. These commitments were documented in the Main Development Agreement executed by them. One of these commitments was 4n undertaking to enter into an agreement with Genstar and the City to ensure that there will be an equitable distribution of costs for the provision of sewerage works to service the Westview Heights and Genstar Lands. The sewerage works include two sections of gravity sewers, a pump station and corresponding force~main. Because the need for the sewerage works were not immediate it was agreed by Council at the time to defer the finalization of this agreement until such time that all parties involved would have the opportunity to negotiate their position with each other. Negotiations have taken place since that time even involving the new owners of the Westview Heights Lands (Sandcasties Capital Corporation and No. 16 Great Projects Ltd.). We have arrived at a point when all parties are reasonably satisfied with the terms of the agreement. The attached agreement reflects the final terms of negotiation. The City's solicitor, Mr. Murdy, has reviewed the attached agreement is satisfied from a legal perspective. Council's approval of the recommendation is respectfully requested. — i TM. Chorgy-?. Eng.
