College of Physicians and Surgeons is in- consistent in enforcing its regula- tions, says a former northwest surgeon who is suing the college. Dr. David Kuntz is slamming the college for shielding a Surrey doctor charged with the murder of a former patient expected to testify against him. © Dr. Joseph Charalambous, 41, is charged with the first-degree murder of Sian Simmonds three months before-she-was—io-testify - against Charalambous in a scxual-misconduct hearing, The college deflected criticism for nat suspending Charalambous by maintaining it could not do so without a hearing. Not so, says Kuntz. *‘T am the college’s worst night- mare because I’m living proof that they do suspend without a hearing,’ he said last week, The renegade orthopaedic surgeon was suspended without a hearing -by the college on Aug, 24, 1986. Kuntz didn’t get his hearing until Oct, 19, 1988. “‘There’s something very, very self-serving. about how they're dispensing their justice,’’ he said. “It’s certainly not to protect the public — it’s to protect them- selves,” The College of Physicians banned the plastic disk replacc- ment spinal surgery that Kuntz pioueered, and later revoked his licence. Kuntz is secking a judicial review of that decision. He has also filed a lawsuit naming the college, the Worker’s Compensation Board and more than 30 doctors he claims con- spited to suspend him in 1986.
