subject to:

1. Consolidation of the properties to the satisfaction of the approving
officer;

2. Solution of the concerns expressed by the Municipal Engineer;
Registration of the appropriate documentation to provide lot 8 with
access to Pitt River Road at a location acceptable to the Engineering
Department:. The Municipality shall be third party of this agreement;

Submission of a design to the satisfaction of the Municipal Planner;

The area be declared a Development Permit Area;

Issuance of a Development Permit;

Submission of a Landscaping Plan that incorporates appropriate paved
driveways over the access right-of-way in favour of lot 8, and
identify common open play «reas.

From the City Clerk, April 12th, 1990 regarding Latecomer Charge Waiver
Agreement 1408 Chelsea Avenue. .

At the request of and pursuant to the Agreement with 375471 B.C. LTD.
dated the 12th day of April, 1990, BE IT RESOLVED that the works and services
described in the aforesaid Agreement and installed or to be installed. by the
said 375471 B.C. LTD. in connection with the development of the lands
described as:

Lot 1, Section 7, Township 40, NWD, Plan 74406
are hereby conclusively deemed to be for the sole benefit of those lands and
that none of the cost of providing the said works and services shall
constitute "excess or extended services" as defined by Section 990 of the
Municipal Act.

AND THAT the aforesaid Agreement be and the same is hereby approved and
that the Mayor and City Clerk are authorized to sign the same on behalf of the
City and to affix the Corporate seal thereto.
