basis of equipment received and one-half of ‘the total cost being
shared on an assessment basis as set out in Column C of the table
on cost sharing proposals annexed hereto as Schedule "G6", and

distributed to the subscribing municipalities in proportion to the
cost borne by each municipality;

Ee . Pursuant to section 770(2) of the Municipal Act the GVRD
may undertake any work or service for a member municipality
provided the work or service is within the power of that munici-
pality and the entire cost thereof is borne by the municipality;

F, The frequencies to be utilized by the regional emergency
communications system are licensed in the name of the Greater
Vancouver Water District. oy poet

NOW THEREFORE the parties hereto agree as follows:

dl. “ - GVRD on behalf of the Participating Municipality will
call for tenders for the purchase of the items of emergency |
communications equipment set out in the columns beside the name o
the Participating Municipality in Schedule "A" hereto (the
"Participating Municipality's Equipment") and the equipment set
(out in the columns beside the GVRD's name in Schedule "A" hereto
(the “Central Equipment"). GVRD shall use its best efforts to
ensure that the Participating Municipality's Equipment and the
Central Equipment purchased under any successful tender will con-
form to the specifications set out in Schedule "B" hereto,

20.07 Title to the Participating Municipality's Equipment
shall vest in the Participating. Municipality and title to the
Central Equipment shall vest in GVRD or if in GVRD's Opinion it is
deemed necesary or desirable, in the name of the Greater Vancouver
Water District,

3... ‘The Participating Municipality will pay its Propor«
tionate Share to the GVRD for the cost of the Participating.
Municipality's Equipment and the cost of the Central Equipment,

such payment to be made to the GVRD no later than 30 days after
receipt. by the Participating Municipality of. the Participating
Municipality's Equipment. If payment is not made by the due date

the Participating Municipality shall pay interest thereon from the
due date until payment in full is made at the rate of ten percent (10)$%
per’.annum. For.the purposes of this agreement "Proportionate
Share" means that fraction the numerator of which is the dollar
amount set out beside the Partjcipating Municipality's name in

column C of Schedule "G" hereto and the denominator of which is
$187,050.

4, GVRD shall have complete discretion in choosing the
successful tender, if any, called for pursuant to section 1 above
