A resolution authorizing the Planning Department to draft Development Permit 46/90; and 2. A resolution authorizing the Mayor and Clerk to sign the Development Permit, subject to: a) Satisfaction of Engineering requirements; b) Revisions of the landscaping plan as recommended by the Parks and Recreation Department; c) Submission of landscaping specifications and securities to the satisfaction of the Parks and Recreation Department. Moved by Alderman Keryluk: Seconded by Alderman Wright: That this application be approved to proceed for rezoning from CS-1 to CD under Section 963 of the Municipal Act subject to: 1) 2) Solution of the concerns expressed by the Municipal Engineer; Completion of the design to the satisfaction of the Director of Planning, with provision of sufficient parking for the retail and restaurant within the designated lease area, on the north side of the existing gas bar; Completion of landscaping plans to the satisfaction of the Parks and Recreation Department; The landscaping plans to include an appropriate combination of fencing and landscaping to create a continuous visual screen along Woodland Drive, to the satisfaction of the Director of Planning; Registration of a covenant to prevent access to this property from Woodland Drive; Issuance of a Development Permit; The applicants being advised that a Rezoning Bylaw will only be introduced after construction of the first phase of the Kitchener/Westwood intersection has started, and final adoption of the bylaw could not occur until these construction works are completed.
