Re: Sanitary Sewer User Rates

Council dealt with che memo from Wayne Easten to ‘Mr. Borch dated February
and, 1973 and listing four categories of situations for determining the sewer
charge on residential properties. I was asked to obtain more information on
the following category:

Il] (a) Where the newly created lots are not serviceable into the subdivision,
(e.g.- 3300 block Oxford).

The strict interpretation of the Municipal Act would permit a reduced charze
to be applied to these lots in view of the fact that the developer has contributed
to the sanitary sewer system; however, in these cases to which this category applies
the property {s ona City street serviced by a City main and should therefore be
charged the regular City’ rate of $5.00 per month.

It would have been possible for the Beveloper to have subdivided these lots

ich front on an existing street and have them connected to the City's sewer with~
out further subdivision or servicing requirements being imposed upon the developer,
and the City rate would apply. Just because the developer incorporates these
lots as part of an overall subdivision which he services should noe alter the

charge that 1s imposed upon these parcels.

Category III (b) -was approved by Council as being elicible for the subdivider

rate. This appears to be in order due to the fact that the lot is serviceable into
the subdivider-installed main.
In order to complete the review of ruses applicable to sewer user rates I

would recommend that Category III (a) be charged the City rate of $5.00 per month.
