Latecomer Charge Waiver Agreement
1637/69/91 and 1711 Mary Hill Road

RECOMMENDATION:

At the request of and pursuant to the Agreement with 382815 B.C. Ltd.
dated the 3rd day of April, 1991, BE IT RESOLVED that the works and services
described in the aforesaid Agreement and installed or to be installed by the
said 382815 B.C. Ltd. in connection with the development of the lands
described as:

Lot 5, District Clot 342, Group 1, N.W.D., Plan 1330

are hereby conclusively deemed to be for the sole benefit of those lands and
that none of the cost of providing the said works and services shall
constitute “excess or extended services" as defined by: Section 990 of the
“Municipal Act. | os .

AND THAT the aforesaid Agreement be and the same is hereby approved and
that the Mayor and City Clerk are authorized to sign the same on behalf of “he
City and to affix the Corporate seal thereto. . a
