We confirm that the solicitors for the fe «al Department of Justice are insistent wt
the City agree to accept an interim "ma nance permit’ under Section 28 (2) of = *
to confirm that the City wil responsible for the maintenance of ¢:
proposed dyke on the Coquitlam Indian serve No. 2, pending the granting of

proposed statutory right of way to the City.

The rationale for that position is that it may be up to a year from the anticipated
cornpletion of the dyke this fall until the necessary procedural requirements for fede
approval of the statutory right of way agreement can be fulfilled. During that interv
the federal government wishes to ensure that someone will be responsible for the
maintenance and repair of the dyke.

in a telephone conversation yesterday, Mr. Cameron of the provincial dyking progray
advised that he has been toid that the federal government will not issue the dyke
“construction permit” until the "maintenance permit" issue is resolved. He also advised _
that he must expend the provincial dyke construction funds for 1993-1994 not later than
March 30, 1994, thus placing him under a great deal of pressure to begin constructiqn.
