Motor Vehicle insurance for public liability and property damage providing
coverage up to five million dollars ($5,000,000) inclusive on owned, non-
owned or hired vehicles.

Completed operations coverage on al! risk occurrence basis up to two
million dollars ($2,000,000) Inclusive against liabtlity or bodily injury,
death and/or damage to property of others arising out of the existence of
any conditions in the work when completed or any installation or repair
operations during the period of 12 calendar months next ensuing after
acceptance of the work by the Municipality.

PATENTS AND/OR COPYRIGHTS

The Contractor shal | pay all royalties, patent or copyright fees and hold and
Save the Municipality, its officers, agents, servants and employees harmless
from liabtlity of any nature of any kind, including costs and expenses for on
or account of any copyrighted or uncopyrighted composition, secret process,
patented or unpatented invention, articles, or appliances manufactured for use
in the performance of this Contract, including their use by the Municipal ity
unless otherwise specified specifically stipulated in this Contract and if the
Contractor shall fall to save harmiass the Municipality, its officers, agents,
servants and employees in manner aforesaid, any monies collected from the
Munictpality, its officers, agents, servant and employees by reason of such
failure shall be charged to the Contractor.

LAW APPLICABLE

This Contract shail be construed under and according to the laws of the
Province of British Columbia, Canada. . |

PERMITS, FEES, LICENCES, LAWS, NOTICE, ETC.

The Contractor shal | apply for and.pay for al | necessary permits or licences
required for the execution of the work. The Contractor shall give al|
necessary notices and pay all fees required by law and comply with all laws,
ordinances, bylaws, rules and regulations relating to the work and the
preservations relating to the work and the preservation of the public health
and safety, and public and private property.

FAILURE OF THE MUNICIPALITY TO TAKE ACTION NOT_A WAIVER OF ITS RIGHTS

No action nor want of action on the part of the Municipality at any time to
exercise any rights or remedies conferred upon it under this Contract or
otherwise shal! be deemed to be waiver on the part of the Municipality of any
of its said rights or ramedies.

ORAL, AGREEMENTS

No oral instructions, objection, claim or notice by any party to the other
shall change or modify any of the terms of obligations contained in any of the
Contract documents and none of the provisions of the Contract documents shal |
be held to be waived or modified by reason of any act whatsoever, other than

by an agreed waiver by modification thereof in writing.
