Further, the definition states that the industrial use shall produce no noise, smoke, smell, etc. Who will define the section “that may in any way interfere"? What will you do about Mr. Smith who has a personal prejudice against a particular language? Will he be able to have a Company closed down because the employees speak Spanish and he can hear them talking in his back yard by the fence abutting the industrial building which, because it is a hot day, has the loading doors open to allow some airflow through it. Mr. Smith will then pay a visit to City Hall and say that his residential use is being interfered with. The wording of the by-law indicates that the City will have no choice but to enforce the by-law and have the Company leave. Now, is this what you intend? If not, why not drop the proposal altogether? Regulations are already in place (the noise by- law). to-take care of the problems that I believe you wish to. have control over through this definition. If it is in your wisdom to proceed with this by-~ law without considering the potential problems, then might I suggest that you may be considered prejudiced against © industrial uses. Why is it that industrial users are always seen as. being a- negative impact on adjacent residential uses? Believe me, it is no treat to operate an industrial business close to. residents either. I have read the Planning Report that led to this proposed amendment and must comment that this whole issue comes down to one simple fact. The Planning Department is misinterpreting the M-3 permitted uses regulations and is denying almost every business licence application that is submitted. The problem is that due to the fact that the by-law is intended to be "streamlined and uncomplicated", business licences are being denied because the specific users are told that their use is not permitted under the regulations.
