THE CORPORATION OF THE C\TY OF PORT COQUITLAM BY-1AW NO, 3386 , A By-law to authorize the City to enter into Land Use Contract No. 15. WHEREAS the "City of Port Coquitlam Zuning By-law, 1969, No. 918" a8 azended designates certain areas of land within the zones set out therein as “Developmeat Areas"; . AND WHEREAS the lands hereinafter described are situate within an area so designated; AND WEEREAS the Owner of the said lands has made application for a Land Use Contract to authorize works, development, and use soze aspects of which are not ia conformity with the relevant City By-laws as the Same apply to the zone in which the said lands are situate; AND WHEREAS the Council has given due regard to the following considerations: 2. (a) the promotion of health, safety, convenience and welfare of the public. . (>) the prevention of tke overcrowding of land, and the Preservation of the anenicies Particular to any zone. (c) the securing of adequate light, air and access, (2) the value of the land and the Nature of its present and prospective use and occupancy, (e) the character of each zone, the character of the buildings already erected and the peculiar suitability of the zone for particular use. the conservation of property vclues. the development of areas to promote greater efficiency and the iapact of development on present and future public costs, the betterment of che environment. the fulfillment of commnitcy goals. the provision of necessary public space. and it is deenea cesirable to enter into Land Use Contract No. 1§ in the form and to the extent hereinafter provided; NOW THERRPORE the Municipal Council of The Corporation of the Ciry of Port Coquitlam, in open meeting assembled, enacts as follows: 2. The Council of The Corporation of the City cf Port Coquitlam is hereby authorized and espowered to enter into a Land Use Contract with Horner Developments Ltd., 1036 Cambie Road, Richmond, B.C. in the forn and to the extent set forth in “Lond Use Contract No. 15 vhich is the Schedule hereto annexed and male part of this By-law, 2. Ihe said Land Use Contrict No. 15 shall extend to and shall regulate the development and use of the lands described as: Lot 34 and Lot 35 of Block 3 of District Lot 379, Group One, Plan 1213, New Westminster District. 3. Land Use Contract Ne. 15 shall have the force and effect of a restrictive covenant running with the land described in Section 2 hereof and shall be registered in the New Westminster Land Registry Office by the City. This By-law way be cited for #11 purposes as “Land Use Contract No. 15 Authorization By-law, 1975, No. 1399", Read a first time by the Municipal Council this Sixth day of October, 1975, Read s second time by the Municipal Council this Sixth day of October, 1975, Public Hearing held this Twentieth day of October, 1975.
